The website vinniesfinds.com.au ( or “Site”),is operated by St Vincent de Paul Society NSW (ABN 91 161 127 340). Throughout these Terms of Service, the terms “we”, “us” and “our” refer to St Vincent de Paul Society NSW, and the term “Service” refers to our provision of our online store through our Site, and our associated services.
These Terms of Service (or “Terms”) and our Returns and Shipping pages govern the supply of any products ordered by you on the Site and your use of the Site. By browsing, accessing, using the Site, making an account or ordering a product, you agree to be legally bound by these Terms.

Our online store is hosted on Shopify Inc. Shopify provide us with the online e-commerce platform that allows us to offer the Service to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority where you live, or that you are the age of majority where you live and you have given us your consent to allow any of your minor dependents to use this Site. If you allow your dependents to use this Site, you remain responsible for what they do.

Credit card information is processed through Shopify Payments.

Except as required by law (including the Australian Consumer Law), we do not guarantee that information on this Site is accurate, complete or current. Other than product listings, material on this Site is provided for general information only. To the extent permitted by law, any reliance on the material on this Site is at your own risk.
This Site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information on our site. Section 4 - Modifications to the Service and Prices, Suspension and Discontinuance
Prices for our products are subject to change without notice.
While we endeavour to give you advance notice if we decide to close our online store, we reserve the right at any time to modify, suspend or discontinue the Service (or any part or content thereof) without notice at any time. However, if you have already made a purchase:
• we will deliver the items you have ordered and provide associated services; and
• if you have any store credit, then you can contact us to exchange it for a refund of the value of the credit.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Section 5 - Purchases and Returns

We have made every effort to display as accurately as possible the colours and images of our products that appear at the online store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
Many or all of the products we sell through our online store are second hand, and so their condition will vary. The listing for the product will identify its condition and quality, so you can check if that description is acceptable to you before you purchase it. We do not knowingly sell products that infringe third party intellectual property rights. However, to the extent permitted by law, we are not liable if a product does so.

Without limiting your rights under the Australian Consumer Law, we do not warrant that the quality of any products you purchase will meet your expectations.
Section 6 Promotions and Discounts
We may offer promotions, discounts, or sales from time to time. Each promotion is subject to these Terms and any additional terms notified at the time of the promotion. Promotions are available only during the stated promotion period and are subject to any eligibility requirements, exclusions and limits notified at the time of the promotion. Unless stated otherwise, a promotion cannot be used in conjunction with any other promotion. Promotions cannot be redeemed on prior purchases.
Section 7 - Shipping

Section 8 - Accuracy of Billing and Account Information
You may choose to make an account on the website through which you may make purchases.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our online store. You agree to promptly update your account and other information, including your email address, credit or debit card numbers and expiration dates (held by Shopify Payments), so that we can complete your transactions and contact you as needed.
If we reasonably suspect that you are engaging in any fraudulent activities, we may cancel any order you place with us in accordance with Section 9 below and, where reasonable, we may suspend or block your account.
If our online e-commerce platform suspects you are engaging in fraudulent activities, it may refuse to process your order.
Section 9 - Order Cancellation
If we cancel an order for any reason permitted by these Terms, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made and, except where there are legitimate concerns related to fraud, we will promptly process a refund for the affected products to the credit card that you used to place the order.
Section 10 - Third-Party Links
Third-party links on this Site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

In these Terms, “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Nothing in these Terms of Service excludes or limits, or has the effect or excluding or limiting, the operation of the Australian Consumer Law or any right you may have under the Australian Consumer Law.
The products you purchase through the Service may come with consumer guarantees under the Australian Consumer Law. Nothing in these Terms limits your rights or our liability in relation to those consumer guarantees.
Section 16 - Disclaimer of Warranties; Limitation of Liability
This section 16 is subject to section 15 above.
We do not guarantee, represent or warrant that your use of the Service will be uninterrupted, timely, secure or error-free.

Section 17 – Intellectual Property
Unless otherwise indicated, the rights, title and interest (including intellectual property rights) in all content on the website are owned by us or used by us under licence. This content includes, without limitation, all text, graphics, logos, icons, images, video and audio excerpts, designs, interfaces and layout made available on the website. This material is protected by intellectual property right laws in Australia and overseas.
The website may contain trademarks. You may not use our trademarks in Australia or overseas without our prior written consent, except to legitimately identify our products or services.
Section 18 – Breach and Termination
If you materially breach these Terms, then we may suspend or block your account.
If we materially breach these Terms, then if you notify us of that breach, we will use reasonable endeavours to remedy it. You also have the option to cease using the Service.
Section 19 – General Provisions
If any part of the Terms is invalid, unlawful or unenforceable, the invalid, unlawful or unenforceable part of the Terms will not apply but the other parts of the Terms will not be affected.
